License Agreement

We have three simple licenses for Multi-Level Drop Down Menu (MLDDM). One site license per domain name, ten site license for ten domain names and unlimited site license.

Single site license

You may run one instance (a single installation) of the MLDDM on one web server and one web site for each license purchased. Each license may power one instance of the Software on one domain.

Ten site license

You may run up to ten instances (ten single installations) of the MLDDM up ten web sites for each license purchased. Each license may power up to ten instances of the Script on any domain.

Unlimited site license

The Unlimited Domain License allows you to use The Script on any number of websites, intranets and mediums owned by your organization. In addition this type of license also allows you to use The Script on any number of websites, intranets and mediums that are developed or maintained by yourself for third parties. This makes it suitable, for example, for webdesign companies.

LICENSOR'S PROGRAM IS COPYRIGHTED AND LICENSED (NOT SOLE). LICENSOR DOES NOT SELL OR TRANSFER TITLE TO THE LICENSED PROGRAM TO YOU. YOUR LICENSE OF THE LICENSED PROGRAM WILL NOT COMMENCE UNTIL YOU HAVE EXECUTED THIS AGREEMENT AND AN AUTHORIZED REPRESENTATIVE OF LICENSOR HAS RECEIVED, APPROVED, AND EXECUTED A COPY OF IT AS EXECUTED BY YOU.

BY DOWNLOADING ANY FILES FROM SpiceBrains INC, YOU AGREE TO BE BOUND BY THESE TERMS, CONDITIONS, AND REQUIREMENTS. IF YOU DO NOT AGREE TO THESE TERMS, CONDITIONS, AND REQUIREMENTS, DO NOT DOWNLOAD ANY FILES.

• A MLDDM license grants you the right to run one instance (a single installation) of MLDDM on one web server and one web site for each license purchased. Each license may power one instance of MLDDM on one domain.
• The owner license grants you the right to run for an unlimited time.
• MLDDM source code may be altered (at the owners risk), but the software (altered or otherwise) may not be distributed to entities beyond the license holder without the explicit written permission of SpiceBrains Inc.
• Registered users may modify the MLDDM code for their personal use (at their own risk), but any altered code must not be redistributed or resold in any form.
• If any terms are violated, SpiceBrains Inc reserves the right to revoke the license at any time. No license refunds will be granted for revoked licenses.
• License fees are non-refundable. For complete system requirements, please visit the features page.
• Restrictions. You may not distribute copies of the Software in any manner, including, but not limited to, distribution through web site postings or links to the SpiceBrains Inc web site.
YOU MAY NOT RENT, LEASE, LOAN, RESELL FOR PROFIT, DISTRIBUTE OR CREATE DERIVATIVE WORKS BASED UPON THE SOFTWARE OR ANY PART THEREOF.
• Ownership. The Software is copyrighted by, proprietary to and a trade secret of SpiceBrains Inc. SpiceBrains Inc retains the title, ownership and intellectual property rights in and to the Software and all subsequent copies regardless of the form or media. The Software is protected by the copyright laws of the United States and international copyright treaties. This License is not a sale of the Software.
• Termination. This License is effective until terminated. This License will terminate automatically without notice if you fail to comply with any of the provisions. Upon termination you shall destroy all copies of the Software including any partial copies.
• Disclaimer of Warranty. YOU ACCEPT ALL RISKS WHICH MAY ARISE FROM THE DOWNLOADING OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO ERRORS IN TRANSMISSION OR CORRUPTION OF EXISTING DATA OR SOFTWARE. SPICEBRAINS INC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY WARRANTY OF NONINFRINGEMENT OF THIRD PARTIES' RIGHTS, WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.
• Limitation of Liability. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL SpiceBrains INC OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF SpiceBrains INC SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Disclaimer of Warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.

SpiceBrains Inc is not liable for the content of any message posted on any web site powered by MLDDM.

The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
